The Netroots community has been all over of the story of California state Senator Leland Yee, who began receiving death threats after he demanded an apology from Rush Limbaugh, who delivered a rant on his show ridiculing individuals of Chinese descent.

Senator Yee's office has reported receiving a new set of threatening letters, some of which bear crosshair graphics.  Meanwhile, Limbaugh's supporters are flooding Senator Yee's office with hundreds of phone calls actually supporting Limbaugh's hateful remarks!

The Right's War Against Public Trust Fishing Rights

There has been a plethora of right wing talk show host coverage of Obama's so-called "ban on fishing" this week. I find it ironic when folks like Limbaugh and Michelle Malkin, who have wholeheartedly supported administrations that have crushed our fishing rights and instituted massive fishing closures, are now speaking up for the "poor fishermen." What hypocrites they are!

Even more ironic, Sean Hannity and other talk show hosts have collaborated with corporate agribusiness and astroturf groups such as the Latino Water Coalition to promote a propaganda war against salmon and salmon fishermen in a cynical campaing to export more water from the California Delta. These right wingers are the enemies of everybody who fishes and wants to see restored fish populations.

Below is my November 2008 article on the unprecedented anti-fishing, anti-fish policies of the Bush and Schwarzenenegger administrations. Everybody should read this to put this so-called "ban on fishing" into perspective. Unfortunately, Obama's environmental policies towards fish restoration appear to be picking up where Bush left off, particularly in his convening of the National Academy of Sciences panel to review the salmon and Delta smelt biological opinions under pressure from Senator Dianne Feinstein and corporate agribusiness.

Bush, Schwarzenegger and the Wise Use Movement: The Crushing of Public Trust Fishing Rights

The ripping away of public trust access to our waterways and ocean waters by extreme property rights folks and the Bush and Schwarzenegger administrations is something that many sportsmen don't seem to understand. I get sick and tired of some ill-informed sportsmen who point to "animal rights groups," "environmentalists," and "liberals" as the reason why we are seeing more and more areas closed to fishing, when it is the two state and federal administrations that are in power at this time, along with their buddies in the "wise use" property rights movement, that are actually responsible.

Unfortunately, some of the larger, corporate funded environmental groups have served as collaborators with the Bush and Schwarzenegger regimes in instituting no fishing zones along the coast in an egregious example of federal-state-environmental green washing. However, if you actually review the history of fishing closures in California history, the Bush and Schwarzenegger administrations have consistently been the biggest proponents of closures and no fishing zones off the California coast.

The Marine Life Protection Act was passed by a Democratic-dominated legislature, but it is Schwarzenegger, a Republican, that has fast-tracked this process. Most sportsmen aren't opposed to Marine Protected Areas (MPAs); they are opposed to the inequitable and hasty manner in which they have been imposed. MPAs under the Schwarzenegger only "protect" areas of ocean from recreational and commercial fishermen, a largely redundant and punitive effort since salmon fishing is completely closed this season and rockfishing is severely restricted to certain depth areas and seasons by the Pacific Fishery Management Council. At the same time, these MPAs do nothing to cause the declines of fish caused by pollution or help stop future oil and chemical spills from taking place!

Meanwhile, Schwarzenegger has consistently vetoed fishery restoration passed by the Legislature and pushed for the destruction of Central Valley salmon and Delta fish populations by building a peripheral canal and more dams to bail out subsidized corporate water contractors.

Although certain environmental groups support "no fishing" zones in the state's ocean waters, I would argue that the greatest threat to public fishing access is the anti-fishing rights policies of the Bush and Schwarzenegger administrations, as well as the ascendency of the lunatic fringe of the "wise use" property rights movement.

Just look at this year's unprecedented salmon closures in California and Oregon ocean waters and Central Valley rivers. Politically manipulated Bush administration biological opinions, coinciding with Department of Water Resources failures to observe the provisions of the Endangered Species and Clean Water Acts, resulted in massive increases of export pumping and the loss of thousands of thousands of salmon smolts. The DFG's failure to put the salmon in acclimation pens, combined with bad "ocean conditions," produced the "perfect storm" leading to the salmon collapse.

In 2006, the Bush administration, not "liberals" or "environmentalists," tried to close down all recreational and commercial salmon fishing on the ocean off California and southern Oregon, due to the alarmingly low numbers of Klamath River fall-run chinooks. To add insult to injury, these closures were the direct result of the Karl Rove-instigated fish kills of 2002. Fortunately, massive outcry by West Coast Democratic Congressmen and sportfishing and commercial fishing groups allowed anglers to have a season that year, although commercial fishermen were severely limited.

At the same time, right wing property rights fanatics, through compliant Sheriffs Departments and District Attorneys and the anti-fishing zealots in the federal and state governments, have closed off vast areas of public trust access on levees to bank fishermen on the Delta and Sacramento River - in direct violation of the California Constitution.

According to the California Constitution, Article 1, Declaration of Rights, Section 25, "The people shall have the right to fish upon and from the public lands of the State and in the waters thereof, excepting upon lands set aside for fish hatcheries, and no land owned by the State shall ever be sold or transferred without reserving in the people the absolute right to fish thereupon; and no law shall ever be passed making it a crime for the people to enter upon the public lands within this State for the purpose of fishing in any wate containing fish that have been planted therein by the State; provided, that the legislature may by statute, provide for the season when and the conditions under which the different species of fish may be taken."

This right is also guaranteed in Article 10, water, Section 4, "No individual, partnership, or corporation, claiming or possessing the frontage or tidal lands of a harbor, bay, inlet, estuary, or other navigable water in this State, shall be permitted to exclude the right of way to such water whenever it is required for any public purpose, nor to destroy or obstruct the free navigation of such water; and the Legislature shall enact such laws as will give the most liberal construction to this provision, so that access to the navigable waters of this State shall be always attainable for the people thereof."

Since 2001, the Bush administration on the federal level and Governor Gray Davis, succeeded by the even more anti-fishing Schwarzenenegger administration in 2003, have closed more fishing areas and destroyed more fisheries than all of the previous administrations, Democratic and Republican, combined.

Fishing closures that have taken place under the Bush and Schwarzenegger administrations include the following:

• The complete closure of the continental shelf in federal waters to rockfishing, due to federal and state mismangement of the groundfish fishery for nearly a decade by the PFMC.

• The adoption of severely restricted fishing seasons for rockfish, lingcod and greenling in recent years, along with early closures this year and last based on the rebuilding paradox: canary and yelloweye rockfish are rebounding, so anglers have more contact with them!

• The fast tracking of the MLPA process by Schwarzenegger, resulting in massive no fishing zones off the Central Coast, and looming closures on the North Central and South Coasts.

• Increasing closures of bank fishing access on roads, maintained with public funds, on levees along the Sacramento River and throughout the Delta. This started with the closure of the Sacramento River below Freeport and the closures have expanded to include vast areas of public trust access to navigable rivers in Solano, Yolo, Contra Costa and San Joaquin counties. Local reclamation districts, in collaboration with state and federal governments, have fenced off vast tracts of land on the Delta. The Prospect Island fish kill of November 2007, when tens of thousands of striped bass, Sacramento blackfish, Sacramento splittail and other species perished after a levee repair by the Bureau of Reclamation, occurred on federal land that was closed to public access and would probably not have been exposed unless two duck hunters had trespassed on the land.

• Illegal denial of public fishing access by "wise use" property rights advocates on the Cosumnes, Mokelumne, Calaveras, Stanislaus, Tuolumne, Merced and San Joaquin rivers - and numerous other streams throughout the state. The massive evisceration of public trust fishing rights, a gross violation of the California Constitution, has been engineered by local and regional water districts and agencies in collaboration with the state and federal governments.

When all is said and done, these closures have much less to with "preservation" or "conservation" than they do with corporate and agribusiness greed and the desire of corrupt politicans to get the stewards and watch dogs of the environment, anglers like you and me, off the water! Where is the outrage when our fishing rights are being trampled upon everywhere we look?

These media outlets cited the Interagency Ocean Policy Task Force's interim report on coastal and marine planning, but the task force has proposed nothing of the sort.

OK, About That Election...

As for election news in California, the final two polls have been wildly divergent.  SurveyUSA shows a 10-point Clinton lead, while Reuters/Zogby has a 13-point Obama lead.  The final Field Poll (the gold standard, as everyone knows) went with a one-point lead to Obama two-point lead to Clinton, almost exactly in the middle.

Of course, this only tells part of the story, as Marc Ambinder picked up on my caveat that the district-level delegate system will skew the results, particularly in those even-numbered districts, where a high bar is needed to be scaled to get anything beyond an even split of delegates.  And if you expect an early answer about them, think again:

So much for having a hard delegate count on Super Tuesday, we're hearing that CA Dems won't have final delegate tally ready until Friday.

Debra Bowen's mantra has been that she'd rather get the count right than get it fast, so everyone's going to have to wait.  I think it's a small price to pay for voting with a paper ballot.  By the way, DTS voters, fill that bubble!

The Cook Political Report did the same district-level analysis that I did yesterday, and found a considerably larger amount of variance.  Cook thinks that Clinton can get over the 63% bar in those heavily-Latino districts (I'm not so sure).  I understand that the 6-delegate seats require 58.3% of the vote to get a 4-2 split, which seems to me to be possible in Barbara Lee's CA-09 and Nancy Pelosi's CA-08, so Obama could be in an even stronger position than I thought.  And as Councilman Garcetti said last night, they are paying attention to this stuff, on both sides I would imagine.

Finally, we have somewhat neglected the Republican race.  The chic pick is that Romney has come all the way back and will take California.  John McCain is apparently worried about it, since it would mean that Romney has an argument to stay in the race.  Both candidates scurried back here today for extra bits of campaigning.

And yet McCain's people fear he may lose the popular vote in California to Romney -- even if they haul in the same number of CA delegates -- and that the Super Tuesday story will therefore NOT be the crowning of McCain but rather his failure to put away the game, a failure born of his fractious and sometimes unloving relationship with conservatives, especially those millions of conservatives who listen to and abide by Rush Limbaugh and Sean Hannity, not to mention Limbaugh and Hannity themselves, and a failure that in turn will be viewed as both a symptom and a cause of the historic crack-up of the conservative coalition that has sustained and nourished the Republican Party for a couple generations.

Which would be fantastic, since it would be desirable for their race to be as screwed up as ours.  Could the relentless Rush Limbaugh attacks be having an impact?  We'll soon find out.

Why I support the resolution condemning Rush Limbaugh

So there's been quite a bit of controversy over whether or not Democrats should proceed with this resolution to condemn Rush Limbaugh for his "phony soldiers" comment.  I'm going to step into the fray and after annoying some bloggers on DailyKos, probably piss off some more bloggers here by saying I'm in favor of what Congress is doing with this.  And here's why.

You may think this condemnation of Rush Limbaugh is pointless.  And on some level, that's true.  But for far too many years, Democrats have been accused of being "spineless", mostly because they are.  They don't seem to stand up to fight back right-wing lies and smears.  They just let it happen.  You know, like Bob Shrum telling John Kerry NOT to respond forcefully to the Swift Boat lies.  Look how well that worked out.  You see the right-wing raise their false outrage machine all the time every time the left does or says something they don't agree with.  And usually, the person on the left is actually forced to apologize or issue a retraction!  Can you believe that bullshit??

Two Wrongs Compromise A Right

Over the weekend, Rep. John Hall (NY-19) posted a diary on DailyKos announcing his intention to introduce a House resolution censuring Rush Limbaugh today:

I know that there is a back and forth about whether another condemnation is worth the time. I happen to believe it is in this case. Therefore, I'm introducing a resolution that shows emphatically that Congress will not condone ad hominem political attacks on U.S. troops. On Monday, I'm introducing legislation to express the Sense of Congress that this body rejects and condemns Limbaugh's heinous remarks, and will continue to engage in a debate on ending our involvement in Iraq that eschews character-based attacks on our Armed Forces.

Hall's action followed on the heels of an email blast sent out by Jerry McNerney under the heading Chickenhawk Limbaugh Goes Too Far:

Yesterday, right-wing icon Rush  Limbaugh insulted everyone who has served our nation in uniform.

In an exchange with a caller, he actually called troops who return from Iraq and voice their opposition to the war "phony soldiers."

Where does Rush Limbaugh get the moral standing to pass judgment on our heroes who wore this nation's uniform and returned to exercise their First Amendment rights? Even for Rush, that's too far!

Will you join me in calling the following radio stations to demand they take Rush's show off the air?

Meanwhile, Mark Udall (CO-02), the Colorado Congressman who is running for Senate in 2008, is seeking support for his own resolution to censure Limbaugh.

So why is it that after nearly 20 years of listening to Limbaugh's blather, these Congressmen are suddenly SO offended by this particular comment? Gee, you don't think it could be anything so politically craven and cowardly as a CYA for their votes in favor of censuring MoveOn, do you?

That's right -- all three of these Congress members voted to "condemn in the strongest possible terms the personal attacks made by the advocacy group MoveOn.org impugning the integrity and professionalism of General David H. Petraeus." So when they faced the inevitable strong blowback from their supporters (why are these guys always surprised by this stuff?), how did they respond? By trying to paint their stand as a noble, bipartisan defense of our troops. With all the problems facing us in the world, their primary concern is protecting our soldiers from rhetorical slings or barbs. You want to let them be blown up? Fine. But call them a name? Not on their watch!

Meanwhile, all of the members of Congress who voted to censure MoveOn and who are now contemplating censuring Limbaugh, have violated their oath of office: To protect and defend the Constitution of the United States.

Jerry McNerney v. Comedian Rush Limbaugh

Rush doesn't consider anyone who disagrees with him a real person, that's been obvious for a while.  But I guess the fact that this comes so SOON after the whole MoveOn/BetrayUs thing strikes me as odd.  You'd think that whole deification of the military thing would kick in and prevent him from smearing men and women in uniform so soon.

Jon Soltz of VoteVets has a righteous post.  And Jerry McNerney really has his back up (this is from an email):

Hey, he's consistent, right?  He voted to condemn the MoveOn ad.

I don't want Rush's show off the air.  I think free speech means accepting the speech you don't like.  And this idea that anyone who's ever served in the military is immune from the slightest criticism kind of makes me squirm.  None of this is to defend Rush, who obviously thinks that anyone who doesn't serve the country in EXACTLY the way he sees fit is simply not genuine, and worthy of derision.  There's a difference between MoveOn's substantive, fact-based argument, and Limbaugh's hatred of anyone who doesn't think like him.  But you don't ban it, and you don't ignore it.  You HIGHLIGHT it.  And you make sure everyone knows about the vast emptiness within his soul.

And the sky is blue as well. Anyway, CBS-13, the CBS affiliate in Sacto asked whether Rush's song "Barack the Magic Negro" was racist. The vote was about 80% Yes until Rush pointed the poll out on his show. Now, amazingly 95% thinks it is not racist. Wow! Here's the song--->

I actually think it's more offensive towards Al Sharpton, but nonetheless, take a listen if you so desire.

"Limbaugh is Irrelevant" Schwarzenegger Suddenly Finds Limbaugh Relevant

It was kind of interesting that Arnold Schwarzenegger would publicly distance himself from Rush Limbaugh one day and bridge that distance by going on his show the next.  And something even more interesting happened on that appearance.

Now, I don't think a whole lot of Rush Limbaugh, but he adequately reflected the core argument that conservatives have with the Governor; that Arnold has basically "agreed with liberals" rather than brought about any kind of grand compromise.  I agree with that to the extent that Schwarzenegger is out of step with the nuttiest elements of his party, but he's still a good corporate con, make no mistake.  The "post-partisan" thing is a fig leaf to try to get everyone to like him.

But is it me, or does Arnold act like he's never heard this kind of resistance to his post-partisan godness before?  Judge for yourself; you can read the transcript at Salladay's.
