Breaking: Dirty Trick Delayed

No, not dead, just delayed.  They kept pushing their luck on turning in the signatures and now have conceded that they will not make the June ballot.  (Got this via email, but Meyer's blog has technical problems, will update with link later)

The initiative to change how California's Electoral College votes are awarded in the race for the White House will not appear on the June statewide ballot, according to campaign officials.

In a brief statement e-mailed to reporters this afternoon, the California Counts political team said they are now shooting for the November ballot after being unable to gather enough signatures in time for this week's drop-dead June deadline.

"Due to the tight calendar we are operating under and the challenge of raising money and gathering signatures during the Holiday season," says the statement, "we understand that submitting signatures and having them counted in time to make the June ballot, is no longer a realistic goal."

They are now shooting for the November ballot.  However, like Meyers notes that there are two major problems with that strategy.  1) The turnout will not be as favorable for the Republicans as it would have been in June.  2) If it were to pass there would be a court challenge over whether it would count for the election occurring on the same day.

We have killed it twice now and we will for a third time if necessary.

[UPDATE] 3:20 pm Here is the SacBee breaking story that has a crucial piece of information:

California Counts has until Feb. 4 to submit their signatures, a deadline representing six months after the initiative was approved for circulation. Gilliard's statement said his group had collected more than 500,000 signatures; political strategists believe they need about 700,000 to ensure they have enough valid ones to meet a state threshold.

"CalCounts will continue with its fundraising and signature drive because we believe Californians deserve the right to vote on this important initiative to reform the Electoral College and to make our state count again in presidential elections," Gilliard said in the statement.

There has been a lot of confusion over when the dirty tricksters needed to turn in their signatures.  The hard deadline was Feb 5th, but that is also when they need to be certified by, so they obviously had to turn them in before then.  The County Registrars need time to do the random counts and if that failed, to do a full count.

They are busy preparing for the primary, thus can't be devoting a lot of resources to a count.  The dirty tricksters pushed it so far that it is now impossible to get certified in time for the June primary.  But if they get the 200,000 more in by February, it will make the November ballot.

But it raises the question - can they change the rules of an election at that same election?

It would seem to also be more difficult for them to win at the November ballot instead of the much, much lower turnout June ballot.

They can send me a petition now, I'm ready to sign.  PLEASE PLEASE PLEASE give progressives a rallying cry to energize what will already be massive turnout and help us everywhere down-ballot.  2/3 would be a virtual certainty.

So, is having the Dirty Trick on the November ballot really helpful for the down-ballot Dem's?  It would seem that it would be a rallying cry to energize both Reeps and Dems.  It seems that Reeps who would have otherwise stayed home because they knew their Presidential vote didn't matter will suddenly be energized to vote in the hope that they can steal the election.  This would seem to result in an unusually hight Republican turn-out.  

And on a different topic, I agree that a November proposition should not be allowed to affect an election on the same day.  But do we really want the Courts to pick the next President again?  It worked out so well the last time they did.

I can only begin to imagine the hell that would break loose if the entire Presidential election was campaigned on the presumption of one electoral system and then after election day it turned out that the rules were being retroactively changed.

It may be possible to "change the rules of an election" in this case because the November vote is a vote to select the electors to the electoral college.  Then the electors meet in December to cast their vote for President.

Add to this potential legal challenges in a very short time -- such as whether or not the people versus the state legislature can enact a change like this (see the U. S. Constitution Article II Section 1, second paragraph, first sentence) --  and we could have a real ugly situation.  

I am working on a diary that I will post later about what we can do to override all of this.  Basically it involves putting a second initiative on the November, 2008, ballot that would maintain the current "winner-take-all" method unless or until the State of California enacted the National Popular Vote concept.

but remember that the Republicans have lots of deep pocket donors willing to foot the bill for this stuff over and over and over and over and over to drive their base to the polls, and maybe get something out of it themselves.

As far as the retroactiveness (simulactiveness?) of it, is there any language in the prop itself that says when it starts applying? Like does it say "Starting Nov 08, ..."?

they'll get their 200,000 additional signatures.  

However, I think the important questions are:

-how much more of a black eye can we give them nationally and harm the campaigns of Republicans all over?  The Courage Campaign 60 Minutes video was a bodyslam - let's get even more incriminating video and force it on the national scene again and again the reality that Republicans hate democracy and their MO is to try to steal elections.  That's pretty damn damaging to their Republican 'brand' is we can make that stick.

-can we catch them in the act and get some of these out of state carney-type signature gatherers prosecuted and convicted?  Let's change the way things work.  If we can make these bounty-hunting signature gatherers fear getting caught and prosecuted, then they might think twice about the underhanded tricks they use to get people to sign these damn petitions.  

-Finally, are we going to use this Dirty Trick to get a ballot petition to outlaw per-signature payments for signature gatherers?  Now, THAT'S a ballot petition that would be worth signing!
