Is Chuck devore ripping off Charles Schwab?

Someone needs to talk to Chuck.

If you've been watching your TV over the past few months, you've undoubtedly seen the rotoscoped ads (edited based on user input) from Charles Schwab that feature that tagline Talk to Chuck..  When you visit the website, you should notice the emblem at the lower right corner: a square "talk bubble" with "talk to Chuck" inside it.  Notice the style and font.

Now go over and have a gander at the website of self-styled conservative Republican (why anyone would call themselves that these days is beyond me) Chuck Devore, who is challenging Barbara Boxer for her Senate seat in 2010.

Scroll down.  Notice the "talk to Chuck" with the square talk bubbles and a very similar block font?  Definitely not coincidental.  And IANAL, but does this constitute some sort of infringement of intellectual property rights?  After all, if I were a brokerage, I wouldn't want to be associated with a political candidate on either end of the spectrum.  Then again, if I were a political candidate on either end of the spectrum, I wouldn't want to willingly associate myself with a brokerage house.  But then again, I'm not Chuck Devore.

If you've been watching your TV over the past few months, you've undoubtedly seen the animated-gloss ads (David, I'd love it if you gave the technical term for the animated real-life style that's so trendy these days) from Charles Schwab that feature that tagline Talk to Chuck..

It's called rotoscoping; it looks so real-life because the technique involves tracing over live-action movement.

Here at the Chuck DeVore campaign we love to follow Calitics (albeit we probably disagree with the political leanings a tad bit).  

That being said the "supposed" parallel is not an IP infringement since we are not in the same industry.

The real meaty fictitious IP fight is happening on YouTube where Don Henley is trying to shout down our right to parody and political speech.  Here's the latest in that engagement:

Before Chuck gets his head handed to him by the voters in 2010. And god forbid you take some time out of arguing with Don Henley to actually help the thousands of people in your district - including my hometown of Tustin - who are suffering from conservative policies.

Your spat with Don Henley is another sign of your dedication to a Zombie Death Cult mentality - you like picking a fight with an outspoken liberal entertainer, but nobody else in the state cares about it.

It, and the borrowing of the Charles Schwab motif, do indicate a lack of originality. Which, let's face it, is to be expected from Orange County Republicans.

Calitics readers know what it means to get "above the noise". The parodies (first of Obama and then of Boxer) serve that purpose and provide a decent critique of both liberals.

It probably took Chuck all of an hour to pen the satire.  How much time is Boxer spending on this future best selling novel do you think?

Of course, some sources credit Chuck with something more than a "lack" of of originality.  At least he's willing to engage with all sides in an intellectual way.
