Oscar Grant Shooting Protests In Oakland

KTVU Channel 2 and other Bay Area stations have been showing video of, and the SF Chronicle are reporting about angry protests in Oakland over the horrific BART police shooting of unarmed man Oscar Grant on New Year's Day:

A protest over the fatal shooting by a BART police officer of an unarmed man mushroomed into a violent confrontation tonight, as a faction of protesters smashed a police car and storefronts, set several cars on fire and blocked streets in downtown Oakland....

The protest started peacefully shortly after 3 p.m. at the Fruitvale Station in Oakland, where BART police Officer Johannes Mehserle shot 22-year-old Oscar Grant of Hayward to death early New Year's Day. BART shut down the station well into the evening commute, although the demonstration there was peaceful.

However, shortly after nightfall, a group of roughly 200 protesters split off and head toward downtown Oakland, prompting the transit agency to close the Lake Merritt station.

Oakland Police Officer Michael Cardoza parked his car across the intersection of Eighth and Madison streets, to prevent traffic from flowing toward Broadway and into the protest. But he told The Chronicle that a group of 30 to 40 protesters quickly surrounded his car and started smashing it with bottles and rocks.

I've specifically tried to avoid calling this a "riot" and oversensationalizing this, because the protest's turn shouldn't take away from the real story here, which is the growing intensity of public outrage over the obviously unjustified shooting death of Oscar Grant at Fruitvale Station by BART officer Johannes Mehserle. Mehserle has refused to answer questions about the shooting, and BART police have apparently been VERY slow to get information.

The shooting death, and the public outcry, may well be predictable outcomes of three decades of militarizing the police, limiting and eroding fundamental Constitutional protections of individual rights, and a deliberate decision by many Americans to simply abandon cities like Oakland to their fate.

When police officers feel they can act with impunity, the public loses faith in their honesty and their ability to fairly offer justice. Police brutality and even murders have become all too commonplace in many American communities. And let us not forget that many of the practices of Guantanamo Bay were first tried out in American prisons.

Whatever happens in Oakland tonight, and in the coming days and weeks, it should hopefully become clear that America's approach to policing needs to undergo a fundamental change. Of course, Oakland was the scene of a similar turning point 40 years ago with the rise of the Black Panthers. We will see whether this time the right choices are made.

So my wife gets on BART this afternoon in Downtown Oakland...they start to head out and all the sudden the train operator comes on and tells everybody that after the next stop the train is heading directly to Fremont. It's not stopping at any of the other stations due to "civic unrest." Shortly thereafter they started stopping at the other stations besides Fruitvale, but man, sure makes for an interesting commute.

I can see a bunch of news vans from my window, but no protesters so far...

...this was as of 10PM last night. The protests are quiet for now but the outrage is still very much there.

I saw it on the news last night. My comment was more regarding the possibility of more protests this morning.

On that note, there are a couple dozen people on the sidewalk, and the cops seem to be shutting down the intersection at 20th and Webster.

I'm sure the protests will continue for a little while, especially in the absence of any clear leadership on the issue - whether the shooting itself or the underlying problems of police violence.

may have been referring to the fact that there was some talk last night that the protests would be starting up again this morning. So far that doesn't seem to have happened.

I'm all for the protest, but the windows smashed and cars set on fire aren't helping anything. I understand the frustration and anger and hopelessness. I'm right there too. Taking it out on some poor teachers car or on one of the local small business is just not going to help anything.

If anything, it just makes all of those people sitting at home thinking that Oscar is just one less thug on the street, feel justified in their bigoted opinions.

And it's shifted attention on the topic away from the shooting itself and towards the handful of violent protesters, which is unfortunate.

I'm not a legal expert, but - shouldn't the BART cop have been charged with something by now?

Honestly, probably not, especially since you have to investigate to figure out what happened so that you don't have to go back and amend all of your filings.  I'm not going to predict the future, but right now there's no immediate evidence that the investigation of this is going badly, and while I don't want to read minds here, I imagine they're not worried that the BART officer is going to flee jurisdiction and so they're taking their time putting together a proper filing.  The only reason to arrest or charge before you're ready is to prevent ongoing criminal activity (See: Fitzgerald charging Blago early) or to prevent your suspect from fleeing jurisdiction, and this is such a sensitive situation that nobody wants to do anything before they have their ducks in a line.

Dellums told protesters that he had asked the Oakland Police Department to investigate the shooting. "I have asked Oakland police to engage in a fair, parallel investigation, the way you'd investigate any homicide in Oakland," he said. "If that leads to an arrest, that's what it would lead to."

For once, sounds like Oakland may be getting it right.

The destruction in downtown Oakland is so depressing (0.00 / 0)

There's glass everywhere. Tons of broken windows and burnt debris. Store owners surveying damage with blank stares on their faces. I feel heartbroken. Oakland did not deserve this. For once, the Oakland PD are not to blame for what happened, and neither are Oakland officials. Yet people take out their anger on our city.

The mob smashed the windows at Creative African Braids on 14th Street, and a woman walked out of the shop holding a baby in her arms.

"This is our business," shouted Leemu Topka, the black owner of the salon she started four years ago. "This is our shop. This is what you call a protest?"

...

"I feel like the night is going great," said Nia Sykes, 24, of San Francisco, one of the demonstrators. "I feel like Oakland should make some noise. This is how we need to fight back. It's for the murder of a black male."

Sykes, who is black, had little sympathy for the owner of Creative African Braids.

"She should be glad she just lost her business and not her life," Sykes said. She added that she did have one worry for the night: "I just hope nobody gets shot or killed."

If nothing else, I'm glad she gave her name, in the event she ends up charged with something ;p.

This is really making me sad.  I get that they're angry, and I know that not everyone is being violent, but... There are so many other ways to protest this, and now this is going to be remembered more for the riots than for the cop.

Especially since so many downtown establishments are already struggling. And I know many of these business owners - they are incredibly kind people who treat their customers like family. I can't believe anyone would wish this fate on them.
