Great Work, California Republican Party

by: David Dayen

Mon Nov 03, 2008 at 14:02:23 PM PST

It is sadly typical of the knuckle-draggers in the California Republican Party that they picked today to file a lawsuit over Obama's travel to Hawaii to visit Mrs. Dunham for the last time.  The RNC jumped on this lawsuit filing today as well.

Turns out she passed away today.  Obama took time off the campaign trail in the final weeks to say his last goodbyes.  Unfortunately she could not make it to Election Day.

What a classy bunch over at the CRP offices.

RIP Madelyn Dunham.

...I should also note that the Nevada State Director of the Obama campaign died from a massive heart attack this morning at the age of just 44.  Much of my volunteer efforts for Obama supported Nevada.  This is also a tragic loss.

Not only is the CRP heartless, it's also clueless.

Perhaps the first year lawyer who drafted that Complaint should take a refresher course in campaign finance laws. Obama using his plane to travel to and from official campaign events (from a campaign event in Indiana to Hawaii and from Hawaii to a campaign event in Nevada) is not "personal use." Roundtrip air travel is permitted to campaign events. By definition, then, one end of the trip is allowed to be personal. McCain using his campaign plane to fly home to his mansion in Arizona every weekend isn't "personal use," and neither is Obama flying to Hawaii.

But ya wanna know what is personal use?

2 U.S.C. 439a(b) (2) Conversion.

For the purposes of paragraph (1), a contribution or donation shall be considered to be converted to personal use if the contribution or amount is used to fulfill any commitment, obligation, or expense of a person that would exist irrespective of the candidate’s election campaign or individual’s duties as a holder of Federal office, including—

     (A) a home mortgage, rent, or utility payment;

     (B) a clothing purchase;

Or, another way of sayin' it: Giving your vice-presidential candidate the campaign Mastercard to take to Neiman Marcus and Saks Fifth Avenue so she can fulfill her dream of reenacting the shopping spree scene from Pretty Woman. You bet'cha, that's "personal use."

The Internet for Dummies.  It's yellow and black and should help you out.

Is there some way to organize a group look at the CRP campaign disclosure reports after the election?  We know how much they value exact compliance with the law.  Maybe we can help them.
