Building Sale is Blocked

by: Brian Leubitz

Tue Dec 28, 2010 at 17:48:55 PM PST

Well, and the ball is officially in the Governor (Once and Future) Jerry Brown's court.  In a brief, one sentence ruling, the California Supreme Court (well, actually some appellate justices sitting in for the Supreme Court), left the stay from the lower court in place.

"The petition for writ of mandate and request for immediate relief from stay are denied." (Document here

So, Governor Schwarzenegger will now have to see how Jerry Brown feels about this particular gimmick. It is worth pointing out that Brown refused to defend these sales, take of that what you will.

Rip Off (4.00 / 1)
Thank God
This was an insider rip off from the word go
What disappoints me is that my 'progressive' State Senator, Mark Leno supported this nonsense
How many other Democrats supported this ?

Save California tax payers, Jerry

I hope the OC Fair building sale gets blocked too.

I have friends who have been working hard on that one.

Fry, don't be a hero! It's not covered by our health plan!

ABX4-22 (0.00 / 0)
The same legislation covered both the Orange County fairground and the other buildings:

http://www.leginfo.ca.gov/pub/...

2)Authorize DGS to sell all or any portion of the Orange County Fairgrounds pursuant to a public bidding process that is designed to obtain the highest and most certain return for the state, as specified.

...

4)Authorize DGS to enter into a sale or long-term lease of 17 specified state office buildings or properties and to determine the terms and conditions for each sale and lease, and requires that each property sold pursuant to this authorization be for no less than fair market value.  Exempts these leases from California Environmental Quality Act (CEQA) when lease is made on an "as is" basis or is otherwise subject to CEQA through local government land use restrictions.

And almost everyone voted for it. (5.00 / 1)
I know the roster from the OC, we're still mad at our whole delegation* for voting for it - even though almost all of them turned against it after the public outcry a year ago, and Senator Correa and Assm. Solorio are in the forefront of derailing the sale.

* The exceptions are counter-intuitive: Two of our Republican Assemblymen were the only ones to vote against the sale of our Fairgrounds from the very beginning: Mike "Drippy" Duvall on the very eve of his self-destruction, and the plain-spoken Jim Silva, whom I interviewed for the Orange Juice:

A prize (0.00 / 0)
for whoever can point to the actual bill so we can all see the tally. I searched for an hour and couldn't figure it out.

Guess I still have San Francisco hippie values, although I'm an engineer

I have the votes (0.00 / 0)
The bill was ABX4-24.  Back when these were decided, I set up grids of the votes for Calitics readers:

ABX4-22, sorry, my typo. :-(

What they said (5.00 / 1)
They said this?
"The petition for writ of mandate and request for immediate relief from stay are denied."

I could have sworn I heard "no f***ing way".
