Despite Spending $46 Million, California Rejects PG&E

I've been a political campaign junkie for years.  And the frustrating part about this job is that after going to Election Night parties, I have to go home and write about it for readers to view the next morning.  So if a particular race takes the whole night to resolve, I could be up very late.  But I had no problem sticking around the "No on 16" campaign party last night until 1:00 a.m. - monitoring the results with Supervisor Ross Mirkarimi, State Senator Mark Leno and our good friends at TURN.  Because last night's defeat of Prop 16 was one of the most historic victories in California history.  Outspent over 1,000-to-one by a monster utility company, consumer advocates defeated by a 52-47 margin an odious measure that would have cemented PG&E's monopoly. To call this a David & Goliath victory does not give it justice.  As my friend Robert Cruickshank wrote at Calitics, it's like "an ant taking down an elephant."  Oh, and Prop 17 failed too.

PG&E is desperate to stop community choice aggregation - where local governments can purchase energy to offer their constituents a "public option" to the company's monopoly.  Proposition 16 would have required a two-thirds vote of the electorate before cities can do community choice aggregation, and cynically dubbed it the Taxpayer's Right to Vote.

Never mind that taxpayers already have the right to vote out their elected officials - if they don't support community choice aggregation.  Never mind that ratepayers were not given the chance on voting for PG&E as their energy provider.  Public power is not even one of my top "issues," but I was outraged that PG&E would try something like Prop 16.

PG&E shattered campaign spending records with $46 million to pass Prop 16 - ratepayer money that we give them every month when we pay our energy bills.  The only organized opposition was TURN (the Utility Reform Network), who only raised $90,000.  Bloggers got creative by making "No on 16" videos, and a hilarious Twitter feed.  But the campaign often seemed like a rag-tag army tilting at the windmills.

When I arrived at the "No on 16" party at Otis Lounge around 9:30 p.m., the results were looking bad.  We were down by about three points, but the night was still young.  Having watched statewide campaigns for years, I knew it would ultimately come down to Los Angeles County - so I quickly went online to check how we were doing down there.

Not good.  The early absentees had Prop 16 winning L.A. County by 13 points, far worse than where we were statewide.  If this kept on during the night, it was going to be painful.  The public power entity in Los Angeles had just raised rates, and folks at the party said it may be why Prop 16 was doing so well.  Small comfort for the largest county in the state.

Mark Toney of TURN was saying we should be proud that we held PG&E to such a close margin, after having been outspent nearly 1,000-to-one - but I cringed when I heard that.  We were losing.  Sure, we were doing pretty well in Northern California - where people know and hate PG&E, but we were getting creamed down south.  Where the votes are.

But as the night wore on, some folks pointed out how well we were doing in counties like Fresno, Madera, and Mariposa.  These are conservative places in the Central Valley, but PG&E had alienated these customers with "smart meters."  I checked how we were doing in San Benito County - which political junkies often say is the bellwether of California state politics.  We were slightly ahead in San Benito County, but only by about 50 votes.

And the L.A. County numbers were trickling in - slowly, but surely.  We were still losing there, but the margin was noticeably trending in our favor.  By now, everyone at the party was huddled around a small number of laptops - while I double-checked the Secretary of State's website with what individual counties were saying.  Places like San Diego and Orange County were coming in where we were behind, but we were not losing ground.

Pretty soon, our three-point loss became a one-point lead - and there was a palpable sense in the air that we could win it.  I wasn't convinced yet - scouring the L.A. County numbers to see if this positive trend in our favor was not going to start reversing itself.

When 58% of L.A. County had been counted, we were ahead there.  I got up, and boldly shouted that we had won.  It reminded me of the scene in Milk, when Jim Rivaldo tells Harvey Milk not to worry about the Briggs Initiative.  L.A. County had just come in, and we were going to win.  By now, I was sure that we had slain the Prop 16 dragon.

During that whole time, Proposition 17 - Mercury Insurance's scam to rip off consumers - had been ahead by a wider margin than Prop 16.  As we were all fixated on the Prop 16 results, it became apparent that Prop 17 results were following similar trends.  By the end of the evening, Prop 17 had likewise had the same fate - it also lost by about five points.

As of 4:00 this morning, Prop 16 is losing 47-53 - with 91.6% of all precincts reporting.  Not only is this a stunning rebuke of PG&E, but it is a strong mandate for public power.  Californians want a choice in the energy marketplace, and are ready for a "public option" that provides them with competitive rates and renewable energy sources.

And PG&E will deserve every share of anger, rebuke and humiliation coming at it.

The defeats of 16 and 17 were (0.00 / 0)
  the main highlights of an otherwise disappointing Election Night. A few days ago I told someone that it would be a miracle if 16 was beaten after all the brainwashing TV commercials and mailers. It was a miracle and having 17 lose made it all the better. Sometimes the voters aren't as stupid as we often seem. Oh yeah, here in Los Angeles, home of Socialized Electricity, we also voted against 16 and 17 (more strongly against 17 than 16 but both went down.)

I was surprised 17 had a harder time going down than 16 (0.00 / 0)
I mean, we already have some of the highest insurance rates in the country, so why the f**k would Californians want to actually make 'em higher, especially in this economy?

"We want to give you a discount!" and didn't get nearly the publicity that 16 did.

I wonder if PG&E CEO Peter Darbee will keep his job after this resounding defeat.  He committed fifty million dollars of corporate resources to a very public humiliation at the hands of a few ragtag activists with barely six figures among them.

How do you explain that in the boardroom this morning, do you suppose?  Love to be a fly on that wall...

The math is compelling (0.00 / 0)
Their gross revenue last year was something like 13.4 Bee-Billion dollars.  The EBITDA from the utility business was about 3.5 Bee-Billion dollars.  46 Emm-million dollars spent on the proposition is less than 2% of that profit -- not quite a rounding error, but it's not much money either compared to what the loss of San Francisco or San Jose as a revenue source would cost them in profit year after year.  I think it was a good gamble for them, and on a nakedly sociopathic corporate level, it would be wrong to punish management for taking the risk.

This is the basic calculus of corporate money in politics:  you can dump massive amounts of money into politics, and still have an amazing ROI on the money spent -- generally you get a far larger return on that investment than you can get on almost any other expenditure.

People just don't understand the scale on which big companies really operate -- they function as massive machines for the concentration of cash collected from hundreds of thousands or millions of individuals. There's a point at which the  difference between what they can do and what any other organization or person can do become a difference in kind, not just in degree.

Not so fast. You're leaving out the cost of bad PR (0.00 / 0)
As a SF resident, I honestly couldn't have cared less about PG&E a few months ago.  They provide my power, I pay them, and it all seems pretty fair.  I most likely would have voted against a city takeover of utilities a few months ago.

But Prop 16 has absolutely enraged me.  It was a disgusting power grab, and I have already contacted my SF Supervisor begging him to take action on getting PG&E out of this city.  All of this happened because PG&E wasted 50m trying to buy a monopoly, and I know I'm not the only one to feel this way.  PG&E effed up big time.

But it was a low-turnout election, voters' memories are short for some things, and PG&E can still run massive scare campaigns on an election-by-election basis, and each of those will truly be a rounding error in the year that it occurs.

Information Voters (0.00 / 0)
When your turnout is 25%, the people who are voting care about voting. This doesn't mean they will always get it right, but if they care enough to vote in an election like that, they will at least know what's going on.

I'm not trying to take away from the defeat of 16. It was the highlight of election day for me. But I do not think we should take for granted that this is some kind of change in the voting public. Getting outspent like that is not going to work most times. Especially when people are showing up to vote for President or Governor. If they even move down the ballot, they aren't likely to do so with much investigation.

In other words, even though conservative, Republican, white, older people are likely to vote in elections like this one, it will be those from that group that read the papers. That's the only way this thing went down.


General Elections Only for Initiatives, please (0.00 / 0)
I don't think primary elections are the right place for referenda, ever.  They are too dependent on one side coming out for its exciting race, like the GOP this time.  What was the incentive for any Democrat to vote in June 2010, unless you were in Marcy Winograd's district?

We need to start a General Elections Only effort for ballot propositions, statewide and locally too.  No primary electorate should make these major decisions.

but they came fairly close.  It does send a message that PG&E remains ready and willing to go to the mat against any future moves toward public power or CCA.  The loss only hurts them if it causes them to lose local campaigns over the next few years.

I'm not sure if I remember a campaign where I was so totally flooded with flyers, etc.  I'm trying to get into the mind of the average voter, and figure out what motivated them to see past this blizzard of PR and reject prop 16.

This rebuke to PG&E (and Mercury Insurance) was one of the few bright spots of the primary.

in campaigns on local development proposals.  In some of those it seems like the last half of the developer's money lost them votes.  

Often the last-minute expenditures are poorly thought out.  In Livermore a few years ago the developers were trying to make themselves look as green as possible, and did a last-minute mailing to every voter of a redwood seedling.  Of course there are no redwoods in Livermore since the climate's bad for them.  But by that point in the campaign I don't think choosing something more suitable like valley oaks would have done the job.

mailings I got this campaign season, the most disgusting is probably the thing purporting to be a "Green Voter Guide" or some such.  And of course, according to that mailer, voting Yes on 16 and 17 were somehow "green."  

I wonder if people are fooled by these things, and if so, how many.  I imagine some must be -- otherwise, who'd spend the money?

It's time for all of us, especially those in PG&E territory, to immediately lobby our local officials to follow Marin's example and get to work making clean energy available in our own communities.

PG&E has done the grunt work of making sure people know about this issue, and thanks to BP there is a surge in demand for clean (green) sources of energy. The time is now, so let's make it happen throughout the state!
